The initiative follows the first-ever report of negative U.S. customs revenue, after $22 billion in refunds tied to legal disputes over tariffs. The letter also questions the legal authority of Section 122 of the Trade Act to impose tariffs so broadly.

Section 122 has been used to establish tariffs in trade disputes, but its application has faced legal challenges. Mass refunds occur when courts rule in favor of importers who contested the tariffs. CBP is responsible for processing these refunds, but senators argue delays are harming companies that already secured favorable rulings.
